Terms of Service
1. About these Terms
In these Terms, “PolyCerno,” “we,” “us” and “our” refer to the operator of the PolyCerno service, and “Service” means our websites, BTC 5-min application, research, data displays, replays, account features and related support.
2. Eligibility and lawful access
You must be at least 18 years old and legally capable of entering into these Terms. The Service is not offered where its use would violate applicable law, sanctions or regulatory restrictions. You are responsible for determining whether you may lawfully access prediction-market information and use the Service in your location. We may refuse, restrict or end access when reasonably necessary for legal, sanctions, payment, security or abuse-prevention reasons.
3. What the Service provides
PolyCerno provides informational and analytical interfaces that organize observations from public and third-party market sources. The Service may display directional reads, synchronized prices, execution-cost estimates, observable transaction activity, market context, historical records and related quality states. It does not place trades, connect to your trading wallet, hold trading assets, operate an exchange or brokerage, or provide individualized financial, investment, legal or tax advice.
4. Google account and account security
Access currently uses Google sign-in. You authorize us to receive the basic identity information described in the Privacy Policy. You are responsible for controlling your Google account, devices and active sessions and for notifying us promptly of suspected unauthorized access. You may not share paid access, impersonate another person, create accounts to evade controls or transfer an account without our written permission.
5. Paid access
Paid access is prepaid, time-limited and does not renew automatically. Prices, supported payment methods, order validity, activation, extension and refunds are governed by the Subscription, Cancellation & Refund Policy shown at the time of purchase. Creating an order does not reserve a price indefinitely or itself transfer funds.
6. Your decisions and responsibilities
You remain solely responsible for deciding whether, when and how to act on any information. You must independently verify market rules, settlement sources, prices, available liquidity, fees, wallet addresses, legal restrictions and transaction details. You must not treat a directional read, replay, historical result or data-quality label as a promise of accuracy, profit or future performance.
7. Acceptable use
You may use the Service for your own lawful purposes. You may not interfere with availability; bypass authentication, payment or access controls; probe or exploit vulnerabilities; introduce malicious code; scrape or automate requests at a harmful or unreasonable rate; reverse engineer protected components except where law expressly permits it; resell access or substantial data extracts; misrepresent PolyCerno data or provenance; infringe intellectual-property or privacy rights; or use the Service to violate law or facilitate abuse.
8. Intellectual property
The Service, including its software, interface, visual design, text, organization, derived indicators and branding, is owned by or licensed to the PolyCerno operator and is protected by applicable law. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service during your authorized access period. They do not transfer ownership. Third-party names, data and marks remain the property of their respective owners.
9. Third-party services and sources
The Service depends on services and data that we do not control, including Google authentication, public blockchains, RPC providers, Polymarket-related interfaces, Binance and Chainlink. Their terms, availability and processing may apply independently. References to a third party identify a source or market and do not imply affiliation, sponsorship or endorsement.
10. Changes, maintenance and suspension
We may correct, update, add, remove or discontinue features, sources, calculations and access methods. We may suspend access to maintain security, investigate misuse, respond to legal requirements, address payment disputes or protect the Service and other users. Where practical, material changes to paid access will be communicated through the Service.
11. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, continuous availability and error-free operation. We do not warrant that data is complete, current, synchronized or suitable for a particular decision, or that use of the Service will produce a particular result. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, PolyCerno will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss; loss of profit, opportunity, data, goodwill or digital assets; trading or prediction-market loss; or loss caused by third-party data, networks, wallets or services. Our aggregate liability arising from the Service will not exceed the amount you paid to PolyCerno during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.
13. Indemnity for misuse
To the extent permitted by law, you agree to indemnify the PolyCerno operator against third-party claims, losses and reasonable costs arising from your unlawful use of the Service, violation of these Terms or infringement of another person’s rights. This does not require indemnification for PolyCerno’s own unlawful conduct.
14. Ending access
You may stop using the Service at any time. Because subscriptions do not renew automatically, no cancellation is required to prevent another charge. Expiry, suspension or termination does not erase provisions that by their nature should continue, including ownership, disclaimers, liability limits and dispute provisions. Refund eligibility remains governed by the Subscription Policy and applicable mandatory law.
15. Disputes and applicable law
Please contact us first so we can try to resolve a concern informally. These Terms are governed by applicable law. A dispute that cannot be resolved informally may be submitted to a court or other competent authority with jurisdiction under applicable law. Nothing here prevents you from using a mandatory consumer-protection process available to you.
16. General
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the Service, subject to applicable law. The current published version of these Terms supersedes earlier versions for future use of the Service.
